1. Introduction

This website, the Alpha World mobile applications, the Parent App and any related online or offline services (collectively, the “Services”) are owned and operated by Alpha World SMC Pvt Ltd, a Single Member Company (SMC) Private Limited duly incorporated under the laws of the Islamic Republic of Pakistan (hereinafter, “we”, “us”, “our” or the “Company”).

Our registered office and principal place of business is at Office No 2D, Street No 28, Javed Market, I-10/4, Islamabad, Pakistan. We offer the Services, including all information, tools, products and content available through them, subject to your acceptance of all the terms, conditions, policies and notices stated here (collectively, the “Terms”).

2. Applicability and updates

• By visiting the website, downloading any of our applications, or purchasing anything from us, you engage in our “Service” and agree to be bound by these Terms together with any additional terms, conditions and policies referenced herein or made available by hyperlink, including our Privacy Policy and Refund Policy.
• These Terms apply to all users of the Services, including users who are browsers, vendors, customers, merchants, contributors of content, parents, legal guardians and child end-users (acting through a parent or legal guardian).
• By using the Services, you represent that (i) you are of legal age to form a binding contract in your jurisdiction (or, if a minor, that a parent or legal guardian is doing so on your behalf), (ii) you are not a person barred from receiving products or services under the laws of Pakistan or any other applicable jurisdiction and (iii) all information you provide is true, accurate and complete.
• We may update these Terms from time to time. Each time you place an order or otherwise use the Services after an update, you will be agreeing to the latest version. Material changes will be highlighted on this page and the “Last Updated” date will be revised.

3. Eligibility and account registration

3.1 Age requirements and parental consent

• Alpha World is designed for users typically aged 3 to 15 and for the parents or legal guardians of such users.
• If the user is under 13 (or under such other age as the applicable law of their country requires for digital consent), a parent or legal guardian must provide verifiable consent before the account becomes active. We obtain this consent through the Parent App or through a signed email-link, as described in our Privacy Policy.
• Parents and legal guardians are responsible for the conduct of, and any use of the Services by, any child under their care.

3.2 Account creation and security

To use certain features, you must create an account. You agree to:

• Provide accurate, current and complete information.
• Promptly update your account information as it changes.
• Keep your password and any PIN confidential and not share them with any other person.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized access or suspected security incident.

We reserve the right to refuse, suspend or terminate any account that we reasonably believe contains false, misleading or unverified information.

4. Terms of usage

You are prohibited from using the Services or their content:

• For any unlawful purpose, or to solicit others to perform or participate in unlawful acts.
• To violate any international, federal, provincial, state or local laws, regulations or rules.
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate against any person on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, disability or any other protected characteristic.
• To submit false or misleading information, including a false age.
• To upload or transmit viruses, malware, or any other code designed to disrupt or interfere with the Services, any related software, the security features of any system or the internet.
• To collect or track the personal information of others, or to spam, phish, pharm, pretext, spider, crawl or scrape any data from the Services.
• For any obscene, sexual, violent or otherwise immoral purpose.
• To grant or transfer your account credentials, energy balance or other in-app entitlements to any other person.
• To attempt to reverse-engineer, decompile, disassemble or otherwise discover the source code or underlying algorithms of the Services, except to the extent expressly permitted by law.

We reserve the right (but assume no obligation) to remove any content, suspend or terminate any account, or refuse Service to anyone violating these Terms.

5. Description of the Services

The Services may include, without limitation:

• The Alpha World “My Alpha Base” dashboard and mini-app shelf.
• Educational, creative, social and entertainment mini-apps such as Solo Study, Virtual Pets, Personal Space, Games, School, Reading, Calendar, Chat Rooms, Alpha News and Gallery.
• A dedicated Parent App that provides parental controls, consent management, usage reports and purchase approval.
• A virtual energy-point system in which energy is earned through certain activities and may be spent on other in-app features.
• Optional, parent-approved purchases of additional energy capacity through certified third-party payment gateways.

We may add, remove or modify any feature of the Services at any time without liability to you.

6. Purchases, in-app billing and energy

6.1 Energy is a virtual item

Energy points are a limited, revocable, non-transferable licence to access digital features within the Services. They are not money, are not redeemable for cash and have no value outside the Services. We may adjust energy balances, costs, daily caps and accrual rates at any time.

6.2 Payment processing

All payments are processed through certified third-party payment gateways and financial institutions. By making a purchase you authorize us, or the applicable app store / payment processor on our behalf, to charge your selected payment method. We do not store complete payment-card details on our servers.

6.3 App-store billing (Google Play and others)

Where the Services are obtained through a third-party app store (such as Google Play), any purchase you make through that store is subject to that store's payment, refund and parental-controls terms in addition to these Terms. Where there is a direct conflict between these Terms and the applicable store's terms in relation to a store-billed purchase, the store's terms shall control as between you and that store.

6.4 Parental approval and pricing

• All energy-pack purchases made through our direct payment flow require explicit approval by the linked parent or legal guardian.
• Prices and applicable taxes are displayed in Pakistani Rupees (PKR) or your local currency before you confirm a purchase.
• We reserve the right to change prices at any time, but such changes will not affect transactions that have already been completed.

6.5 Refunds

Refunds are governed by our Refund Policy (or, for app-store-billed purchases, the relevant store's refund policy).

6.6 Order acceptance

We reserve the right not to process any order. This is usually because (i) we no longer hold stock of the goods or services, (ii) we are unable to deliver to the user's location, (iii) the goods or services ordered are no longer available, (iv) we suspect fraud or violation of these Terms or (v) for any reason outside our control. If we cannot process an order, we will refund any amount already charged for that order.

7. User-generated content

• You retain ownership of any drawings, chat messages, photos, AI prompts or other content you or your child voluntarily submit through the Services (“User Content”).
• By submitting User Content, you (or, for a child, the parent or legal guardian) grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display, distribute, adapt and create derivative works of that User Content solely for the purpose of operating, providing and improving the Services, enforcing safety and complying with applicable law.
• You are solely responsible for the User Content you submit and warrant that it does not infringe any third-party rights and complies with the Terms of Usage in clause 4.
• We may, but are not obliged to, monitor, review, restrict, blur, remove, refuse or take down User Content at any time without notice if we reasonably believe it violates these Terms or applicable law, or is unsafe for child users.

8. Intellectual property

The Services, the “Alpha World” name and logo, and all related software, designs, graphics, characters, anime-style avatars, virtual pet designs, sounds, content, structure, organization and code, are the exclusive intellectual property of Alpha World SMC Pvt Ltd or our licensors. The Services contain valuable trade secrets and confidential information of Alpha World SMC Pvt Ltd.

Except as expressly stated in these Terms, nothing in these Terms grants you any intellectual property right in the Services. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes only, subject to these Terms.

If you believe any content on the Services infringes your intellectual property rights, please contact us at admin.alphaworld@gmail.com with sufficient detail to identify the alleged infringement, and we will investigate in good faith.

9. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information, content and materials found or offered through the Services for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information or material on the Services is entirely at your own risk, for which we shall not be liable. It is your own responsibility to ensure that any products, services or information available through the Services meet your specific requirements.

Educational and informational content is provided for general purposes only and should not replace professional educational, medical or legal guidance.

10. Indemnity and limitation of liability

10.1 Indemnification by you

You agree to indemnify, defend and hold harmless Alpha World SMC Pvt Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from and against any and all claims, demands, damages, losses, costs and expenses (including reasonable attorneys' fees) made by any third party arising out of or relating to (i) your breach of these Terms or the documents they incorporate by reference, (ii) your violation of any law or the rights of a third party or (iii) your use or misuse of the Services.

10.2 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALPHA WORLD SMC PVT LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING (BUT NOT LIMITED TO) LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY OR (B) PKR 5,000.

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

11. Termination

We may immediately change, suspend or terminate your access to the Services, the website or any account, with or without notice and with or without cause, at any time and without liability to you, any other user or any third party. We reserve the right to terminate access where, without limitation, you have:

• Provided us with false or misleading registration information, including a false age.
• Interfered with other users or with the administration of the Services or the website.
• Been the subject of a request by law enforcement or other governmental authority.
• Otherwise violated these Terms or applicable law.

You may terminate your account at any time by contacting us. Provisions of these Terms which by their nature should survive termination (including clauses on intellectual property, disclaimers, indemnification, limitation of liability and governing law) shall survive.

12. Severability and waiver

If any portion of these Terms is found by a court of competent jurisdiction to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it cannot be made enforceable, it will be severed and the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, that failure will not be considered a waiver. Any amendment to, or waiver of, these Terms must be in writing and signed by an authorised representative of the Company.

13. Force majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, civil unrest, government action, labor disputes, internet or telecommunications failures or interruptions of third-party infrastructure or payment networks.

14. Notices, assignment and entire agreement

• Notices. We may give notices to you by email, by posting on the Services, or by any other means we reasonably consider appropriate. Notices to us should be sent to admin.alphaworld@gmail.com or to our registered office.
• Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, financing or sale of all or substantially all of our assets.
• Entire agreement. These Terms (together with the documents referred to in them) constitute the entire agreement between you and us regarding the Services and supersede any prior agreements or understandings.
• No third-party beneficiaries. Nothing in these Terms is intended to confer any rights or remedies on any third party (except for our affiliates expressly entitled to enforce clause 10).

15. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-laws principles. You agree that the courts of Islamabad, Pakistan (including any consumer court of competent jurisdiction in Islamabad) shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
